Kevin Geoghegan Tries Preventing Tom’s River Primary Ballots From Being Printed, But Too Late

Despite reports to the contrary, former Toms River councilman Kevin Geoghegan, who is seeking election to the Ward 2 seat, has not yet filed a stay in an attempt to halt the printing of the ballots for the upcoming primary election.

Reached by phone late Friday afternoon, a county source confirmed to TLS that the clerk’s office has not received any order to halt the printing, which already had been completed.

Geoghegan, who is running for the seat left empty by the election of Dan Rodrick to mayor, filed a lawsuit earlier this week against his opponent, William Byrne, alleging Byrne did not register as a Republican before the filing deadline.

A hearing on Geoghegan’s request is set for April 29 though Geoghegan has asked for the hearing to be held sooner as the deadline for printing vote-by-mail ballots is that same day.

However, the Ocean County ballots have already been printed and an order now would seemingly be too late.

In his lawsuit, Geoghegan also requested that the court to order Ocean County Clerk Scott Colabella to design the Republican ballot in “Office Block” fashion and not in the county line design.

It is unlikely that a judge would grant that request, a ruling was already issued earlier this week allowing Republicans to keep the county line format for at least the June primary.

The Republican primary will be held June 4.

  1. County did not receive an order from the Court, but the candidate did file a request for a stay with the courts. Also, the request for the stay was also a stay on mailing out mail-in ballots
