Yeshivah Student Ticketed For Hitchhiking

hitchhiking_ticketPHOTO: A Yeshivah student hitching a ride was ticketed by police, TLS has learned. The boy, 18, was standing on Forest Avenue and 5th Street looking for a ride at about 10:00 PM last night, when officer Kevin Bell pulled up. The boy says the officer approached him, asked him for his ID and told him to wait while he issues him a ticket.

The boy says he was never warned about it and did not know it’s something he could be ticketed for. He also said the officer did not give him a chance to talk, and immediately issued him a ticket without warning.

“Hitchhiking in NJ is illegal”, Police Chief Rob Lawson tells TLS, “Some stand in dangerous places where drivers have to swerve to void them”, Lawson says. The Chief said he was unaware of this particular incident.

But, says the Chief, the statue (title :39) provides that they have to be in the roadway in order to be in violation of the law, and standing on the sidewalk or on the curb is not illegal.

The Chief added that 95% of the time the officers will not issue summonses, and will only issue a ticket if the officer feels the hitchhiker is posing a danger to himself and to motorists.

The cost of the ticket is $54. TLS-WL78.

  1. 85% of the time I see people hitchhiking they are in the middle of a street where it would be unsafe for the driver to stop.

    I believe it is a “chillul Hashem”… I constantly see these “hitchikers” getting beeped and cursed at.

  3. Hitchhikers and other pedestrians standing in the cross walk cause motorists to stop because of the new law. If you’re not crossing the street please don’t stand in the cross walk. If you are crossing the street, please don’t assume cars are going to stop and rush across without looking. And PLEASE WEAR A REFLECTOR at night. Black clad blobs are very hard to see.

  4. Hitchhiking is extremely dangerous for two reasons one you don’t know the driver, two it is an accident waiting to happen. I would recommend all cheders and yeshivas not to let their kids hitchhike, they should also be strict about boys biking to cheder, the kids must wear helmets and be trained in the rules of the road. It is also important that the bike be in good condition and that the kid be able to bike so far. I once stopped to give a kid a ride to cheder with his bike because he had no more energy to continue. May Hashem watch over our children.

It is just a matter of time until a 14 year old standing in middle of central avenue is hit and KILLED. What then? We hold emergency tehillim meetings to try to understand the tragedy?

  7. I was wondering why sometimes it takes lpd forever to show up and now I know the answer because officers are busy with nonsense ! Until now I gave them the credit that there just overloaded but not anymore

  8. parents and rabbis need to teach these young boys not to hitchhike. i don’t care how safe pple say it is cause it’s absolutely not safe. you don’t know the stranger who will stop over and pick you up. it’s understandable if you do know the person, but it’s still dangerous. and yes, it’s illegal.

    If anyone knows Officer Bell you know he is good at his job. Everyone needs to understand if its illegal for anyone else to do it, its illegal for all residents.   11. Whether is was right to ticket the yeshiva boy or not, is irrelevant to my point …. although I have my doubts as to what the real motive of the police officer was. My point is, its nice to see all these ‘holy than thou’ guys jumping all over these yeshiva boys who at the end of the day have to get themselves to and from yeshiva, lets have a little feeling for these young boys who have to do so much walking when all these guys who are so quick to jump on them are running around with their suv’s …..

  12. Hitch hiking has been against the law for years. It’s about time they are handing out tickets..it’s dangerous the way these boys are standing almost in the middle of the rd. I also agree with anonymous # 10.. The police are always talking on the phones while driving. I know I will get comments defending them saying it is work related..but save it..I don’t buy it!

I have a wagon, and I don’t know what it is…my car or when I’m wearing my hair long, but when boys see me coming, they’re edging out over the white shoulder line with their hands out, leaning forward to see if I’m reacting. The other day I was turning onto Martin Luther King Dr. to go downtown when on the corner was this teen hitching. The car that made the turn in front of me stopped…I mean STOPPED…in the lane a few feet from the corner, looked at the kid, then pulled to the shoulder to pick him up. I nearly rear ended him. Thank God I didn’t because then you’d know who’s fault that would be, right?

  15. It is extremely dangerous to be hitchhiking. I see cars stopping in middle of ROUTE 9 to drop and/or pick up!! It does have to stop. At the same time, I have my doubts as to how well meaning the officers motives were. That is especially true after a friend of Bell’s just told me last Thursday “to watch your back when Bell is around, he loves issuing tickets”. Again, it is illegal and the officer did nothing wrong but did it really call for a ticket?? Maybe a memo to all the Yeshivos with a warning would help to curb this habit.

Second, I know this boy personally and he was not standing totally in the street only a drop off the sidewalk, hence the officer had no reason for turning around the block to ticket him. Also, we dont enjoy hitching, we do it because we have no bus now and need a way to get home. So instead of driving by in your brand-new luxury sedan, stop and do a chesed, thats what Avraham avinu was all about!

    I will never give someone a ride again especially when the hitchiker didnt have the decency to offer to pay.

  19. I have been talking and writing against hitchiking for years. It’s dangerous and a chillul hashem to see so many frum boys hitching on our streets.
    Sorry, Cool Masmid, but young people can walk (it might even do them some good) and if it’s terribly difficult, it’s up to their parents to drive them or get them a ride. I had to do that with my kids and so can anyone else.

They should send a letter to every mosad(school) in lakewood that the principals & roshe yeshiva should forbid hitchiking except in a way which it is legal(like mentioned above by chief larson).I have witnessed many near accidents & chillul hashem by looking at the other cars who had to swerve or hit the brakes to avoid a collision !Enough is enough!
    Picking up people in this situation is not a mitzvah but a mitzvah habah baverah! Chazal say for chillul hashem even yom kippur does not forgive! Please use your common sense! Thank you police dept.for everything you do for us! May hashem (g-d)watch & protect you all !

  23. Incase you don’t know Negba bus service just closed down leaving many Yeshivos without bussing. How are we expected to get to Yeshiva without bussing? therefore we turn to you our nieghbors and friends to help us get to yeshiva. All those who help should know we are very thankful and you have a zechus in our learning. to all those who don’t and are worried about chillul Hashem then please help raise the few thousands dollars neaded for bussing till the end of the zman.
    I happen to be with this Bochur in Yeshiva and, I don’t think him or anyone else in my Yeshiva stands in the lane only on the shoulder.

  24. Cop might be right but #22 is wrong most yeshivas are further than a reasonable distance from their houses and YOU older people could use the exercise more

  25. to #22 I live a 35-40 minute walk from Yeshiva. A regular Yeshiva shachris starts 7:30 so we would have to get up 6:30 and get there hot and sweaty for shachris. Not every one has a parent willing to drive them every day to Yeshiva.

  26. The Mosdos speak clearly against hitchhiking. Unfortunately, many boys are left to fend for themselves for a means to get home or to school. Perhaps parents could pitch in more by arranging car pools and everyone would benefit.

  27. Chillul hashem has other deeper meanings its nonsense to call a hitchhiker with such terminology. On the other hand calling a act of a Yeshiva Bochur a chillul hashem may in itself be a Chilul hashem.

  29. For the record.. This is the same Officer Bell who went around ticketing cars outside of last years Chai Lifeline dinner (as reported on this site). Most of them were overturned when pictures were brought in to court. There are cops who know when and where and there are cops who don’t..

    I agree that the boys have it difficult, however it is the parent’s fault.
    The parents know that the boys need to get to and from Yeshiva.
    They should be driving them or arranging carpools, instead of leaving these kids to fend for themselves, and putting their lives in danger.

  31. Hitchhiking is against the law regardless of the age of the violator. There are multiple location within the Township where hitchhikers can be observed, that show a total disregard for traffic or the presence of the Police. Let all hope that one of these individuals is not picked up by the wrong person that has a horrible ending since so many of the hitchhikers are very young. Then who will be to blame,the Police? Ptl.   32. Whether we all like it or not, hitchiking has become a way of life here in town. I agree 1000% that it has become very dangerous for both the boys and drivers.

    However, just make a small calculation (since most bloggers here get hung up over estimated figures…), lets say there are several hundred or more hitches given every day in our city and many thousands every month. Do you mean to tell me that 1 ticket out of all of those thousands is going to make a dent?? Yes, the officer acted within the letter of the law and did the right thing. But like the chief said, 95% of the time (and its more like 99.99%) they dont issue summons. So, what exactly did he accomplish, aside for all of us bored souls blogging here!?

    My son hitches a lot and I am not particulary happy about it. However, I did instruct him when, where and how to do it for safety reasons. I would much rather him get a ride to yeshiva with someone from the neighborhood who is going in that direction anyway, than drive him and sit in NYC type gridlock on Rt 9…

  34. We are all screaming at the hitch hikers what I think is just as troubling and more dangerous is the people that stop in the middle of the street to pick these guys up. If your going to break the law and pick up hitch hikers pull over to the side of the road. Don’t stop in the middle of madison ave And don’t hold up a whole line of traffic while your picking up or dropping off your chesed hikers. If I wanted to do a mitzvah I will go out and find one to do. Don’t do your “Mitzvos” on my chesbon.

I doubt it that anyone knew that hitching in jersey is against the law; if someone gets a ticket for speeding here, the chief wouldnt say “according to jersey law u cant speed….” That shows that people dont know and are simple not aware of it! My advice is: let the kid come to court and fight it, let the judge dismiss it cause people are simple not aware (when they made the stop for pedestrian crossing they made very1 aware about it including here on TLS) and from now one police could issue this ticket as now people know about it.

  39. I really get a kick out of the people on here that think that police should only do their job when it doesn’t interfere with your day. If you break the law, it doesnt matter if your at a religious festivity or if the activity has become common place in the disfunction that has become Lakewood, your still breaking the law. At that point, the office has the right to do whatever he/she sees fit. Keep up the good work LPD.

  42. To #32, I also couldn’t drive my son to school. I found a ride for him with a neighbor. It’s the parents’ responsbility to get their children to school safely.
    And to #43, the yeshiva bochurim are certainly choshuv, but I don’t think it’s a stretch to call this a chillul hashem. Can you imagine what people must think when they see tens of frum kids standing around hitching in such a hefkerusdik way? I don’t think those thoughts are very pretty at all.

  43. Ignorance of the law is not defence in the eyes of the court. Just because someone says they didn’t know that hitchhiking is against the law by no means gives them the right have the ticket dismissed. Whether he broke the law knowingly or unknowingly is irrelevant. I also find it hard to believe that this officer would have stopped his patrol vehicle which is equiped the a moble video recording system if this person did not do what is alleged. The camera in his car would have captued where the person was standing as well and the entire encounter. Now if the person wants to fight this ticket I hope they are aware that that video will be shown in court. I dont believe that many people are successful fighting tickets when there is video clearly depicting the violation that occured. If he truely did not commit the violation the video should be enough to have the ticket dismissed.

  45. The Twp has constructed a beatiful location perfect for hitchhikers. It’s on 1st and Madison, which is ideal for and Bochurim heading South, there is a roof overhead and even bentches to sit on. If just those ppl heading South stopped off there…

  50. Good job office bell keep up the good work! I am a non-jew and I was at a light and a boy of about 15 stated to try and get in my car. I could not believe he told me he thought I was going to give him a ride. He did not know me at all sometimes good judgement is lacking so cops need to step in!!!!

  51. In the US state New Jersey it is illegal to hitchhike. This is provided by 39:4-5, which states: “Begging rides prohibited. No person shall stand in a highway for the purpose of or while soliciting a ride from the operator of any vehicle other than an omnibus or a street car.”

    Enforcement of this law by the police is very uptight. If you are stopped by the police in this state they will ask you for ID.

    *Its illegal and dangerous and can have serious consequenses. It is about time that an Officer in Lkwd enforced this law.

    That won’t happen when they are busy..they will tell you to call a cab to get home..a ride home may be stopping them from doing something else you will complain about later on..and then would you defend the officer that gave you the ride home and avoided taking an accident or a serious call.

Given that everyone is in agreement that hitchhiking is dangerous in many ways, we have the ability and responsibility to put an end to it. Do not pick up hitchhikers. If they can not get rides by hitchhiking, they will be forced to seek other alternatives.

  54. #23, brush up on the law, it is NOT illegal for a cop to ask for id, what if say he was acting suspicious the officer can run his name to see if he has any warrants.

  55. Children and young adults residing at home are the responsibility of the parents. If they need transportation, it is up to the parents to arrange for a safe source of transportation. It may be provided by the parents, or a car pool, or by friends or known supporters.

    Children cannot be left to their own means. They think like children, not adults. Keep them safe, and plan for their safe transportation.

    my answers:
    1) you said it: enforcing parking or dangerous U-turns: that means someone from “YOUR COMMUNITY” broke the law. so an officer enforces it. because prior that, multiple warnings must have been given out already- and been exhausted. trust me, tickets are written because officers are not in need of wrist exercises, but because they are frustrated with people not following the rules.

    2) its the same officers because officers are assigned “zones” – and certain zones have certain rules that are notoriously broken. be it parking at the BMG, or be it the rampant speeding on rt88(by car dealerships). every officer is assigned to certain zones. and gets to know the cars, the people, the time schedules, and the routines of the people in that area. officers repeated issue warnings and friendly reminders- when those dont work… officers need to ‘crack the whip’ and send a clearer message- because obviously adults, cant seem to learn the easy way and must learn like children, THAT HARD WAY.

  60. Have you ever heard of zones? Each officer has a specific zone they patrol on their shift. It’s usually the same zone each night. Shockingly enough, not every officer has a bank in their “zone” to patrol. So they may look like they are “picking” on certain people but thats their zone and area to enforce the law.

  62. They have no right to ticket a hitch hiker unless he is soliciting a ride on a HIGHWAY.

    Read statute 39:4-5, : “Begging rides prohibited. No person shall stand in a highway for the purpose of or while soliciting a ride from the operator of any vehicle other than an omnibus or a street car.”

    There is nothing illegal about hitch hiking on ANY OTHER ROAD.

    When you break a law it shouldn’t matter who you are, where you are going, or what religion you are. If you deserve the ticket you should accept it.

  65. Hitching is a way for these Choshove Bochurem to get around, mostly to and from Yeshivah. Its essential that they have a safe way to do it. Maybe the PD should be involved in creating these safe places or safe zones, rather than give tickets. It’s called “sensitivity to the needs of the community”. If Officer Bell truly cares so much, and that was the only motive for issuing the ticket, maybe he can show us all and take the lead in having these places setup. Officer Bell, show us how much you really care. Writing tickets is easy, all it takes is a pen, ticket pad, and not much spelling. Making a real difference however might prove to be a bit more difficult.

  66. It is not the PD’s responsibilities to provide or find means of transportation. There job is to enforce the laws. If you don’t like the laws or that they are being enforced, move! Lakewood has become wasy too sensitive to the community as it is. No more excuses and passes. Laws are in place for reasons and need to be enforced.
    You see seem like you would be the first one causing havoc if something happened to a loved one while they were hitchhiking and blame the LPD.

  67. According to the chief it’s ok to stand on sidewalk or curb…. so Bochurim, just do that! ALSO PICK A SPOT 30 FEET BEFORE A GOOD PLACE FOR A CAR TO PULL OVER SAFELY like a wide part of a shoulder or before a parking lot so the car can pull in. I love to give rides but dont stop unless I have a safe place to do so.

  68. To # 23. A lawyer? Really? It is not illegal to ask a pedestrian for identification. An officer can ask, you just don’t have to give it to him. But if you go that route, just realize that you can be handcuffed and taken back to the station to ascertain your identity once the officer has advised you that he is going to write that ticket. Is that what you want for just being a wiseguy?

It is not illegal for the police to stop and ask a random person for ID. The pedestrian can refuse and keep on walking. 2. An officer has every right to stop a pedestrian an demand ID if the pedestrian is committing an offense whether it be a motor vehicle offense or criminal. 3. NJ is not NY so stop comparing the 2 please.

  72. Maybe number 77 should read the definition of highway in the new jersey statutes. N.J.S. 39:1-1
    “Highway” means the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
    Which means any road, street, way, avenue, etc that is open to the public. Meaning Forest Ave. and Central Ave. are included.

  73. Anyone else amazed at the number of responses? It’s illegal to hitchhike and move on. That is the problem in this town. Address the real issues.Lets see if you can find them. They are right in front of everyone.

  74. Thank you officer Bell, I work in lakewood and every day there are people stopping in the road to pick up hitchhikers It is not only annoying but dangerous and illeagal. I actually watch a school bus pick some hitch hikers up on countyline rd and dropped them off a mile or so down the road, no lights or anything and the kids walked into a store and the bus drove away.

  75. to “the truth” what part of illegal resident do you not understand? What is good for one should be good for others. the township can put up a muster area for illegals to find work why not allow illegal hitch hiking, BOTH are wrong!
