Third Circuit Hands Decisive Victory to Kars4Kids in Years-long Trademark Dispute

National nonprofit Kars4Kids celebrates yesterday’s appellate court decision in the case of Kars4Kids v. America Can Cars for Kids, affirming Kars4Kids’ full and unfettered ability to advertise and operate as Kars4Kids in Texas and overturning the previous monetary award.

“The courts have essentially confirmed what the everyday consumer in any part of the country knows: Kars4Kids, with our iconic jingle, is the brand,” says Kars4Kids’ COO, Esti Landau. “While we respect the Cars for Kids in Texas for its charitable work, we are thrilled the Court recognized that we can continue to use all the goodwill and brand recognition we have built up in our name in Texas, just as we do in every other state.”

Today’s decision marks the closure of a lawsuit that started in 2014, and Kars4Kids’ leadership is glad to be rid of the distraction. “Our focus has always been on the charitable work our donation program supports,” says Robert Moskovits, the organization’s president. “With the legal victory behind us, we can get back to what we do best – getting our charity programs the most we can out of every car donated.”

While Cars for Kids may have prematurely touted its case at earlier junctures in court proceedings, Kars4Kids stayed focused on the end goal, and was vindicated by a court ruling that clearly acknowledged and affirmed its full ability to use the Kars4Kids and 1-877-KARS-4-KIDS names and jingle anywhere in the country, including Texas.

  1. Kids Community Denounces Kars4Kids Trademark Dispute Decision
    Upon learning of ‘Kars4Kids’ recent victory in its trademark dispute with ‘American Can Cars For Kids’, which allows Kars4Kids to continue to operate under its current name, Bobby Smith – one of 74 million kids who currently reside in the US, who is also an outspoken leader of the American kid community – told reporters on Thursday that the “Kars4kids trademark victory is a heavy blow to all of the kids in this country who planned on filing their own trademark suit against Kars4Kids.”
    “There’s a logical reason why 74 million kids in this country have been referred to as kids ever since the day they were born,” Mr. Smith, a nine-year old kid from Lakewood NJ. told the ‘NJ Chidrens’ Daily News’ website on Thursday. “It’s because kids like us have always been kids from the moment we arrived into this world until the current moment in time. And our name status will never change, unless we decide, at some point in time, to enter adulthood.”
    “We may not be able to win a trademark suit against Kars4Kids for using our ‘Kid’ moniker,” the outspoken 9-year-old kid told the childrens’ news website, “but to all the kidnappers out there who’ve illegally infringed on our trademark name, let me tell you right now, ‘we’re going to sue you for every penny of ransom cash you’ve ever earned!'”
    “However, Tom Snatcherburg, a leading spokesman for the kidnapping community in the US, told the ‘NJ Chidren’s Daily News’ website just moments ago that the kidnapper community has already decided to change its iconic name.
    “In deference to America’s 74 million-strong kid community,” Mr. Snatcherburg said, “from hereon, all of the nation’s kidnappers have agreed to forego the iconic name of ‘Kidnapper’, and instead call themselves ‘Childnappers’.”
