BREAKING: Judge Orders New Trial in Eisemann Case [PHOTO]

Superior Court judge Joseph Paone has ordered Rabbi Eisemann be granted a new trial, denying a motion from the defense seeking the remaining charges be thrown out.

In their motion, lawyers for the revered SCHI founder argued in that the case must be entirely dismissed, noting that prosecutors violated an intentional Brady violation by willfully hiding evidence, and that the two remaining charges are legal impossibilities after a jury vindicated Rabbi Eisemann on predicate crimes back in February 2019.

However, in his decision, the judge said the violations were not serious enough to warrant dismissal of the charges.

A new trial on the remaining charges is now set for July 9th, with a pretrial conference scheduled for May 15.

This story of Rabbi Eisemann reminds me of a very similar story when the plane got hijacked on the way to Eretz Yisroel and Rabbi Yitzchak Hutner may his memory be blessed was on that plane together with a lot of other wonderful people. They were all in Jordan for about 3 weeks. After about two weeks into this ordeal, Rabbi Chaim Shmulevitz may his memory be blessed he gave a Klop on the Bima before the Yeshiva was about to say Tehillim and he said (I do not know the exact words) Rabbosai, Rabbi Hutner and a lot of other wonderful Chevra, they are still stuck in Jordan, we need to cry out to Hashem. Every single day the Mir Yeshiva and probably many many Yeshivos were saying Tehillim. An Avreich that was there in the Mir during the Tehillim, said that the Rosh HaYeshiva was crying while he was saying Tehillim.
    It looks like Rabbi Eisemann is in a similar situation like a hijacking.

    • I think you’re referring to the Entebbe hijacking which was in Uganda. Rabbi Paysach Krohn said over the story (can be viewed on torahanytime titled “Divrei Chizuk for Eretz Yisroel” towards the beginning).

        • every story has good guys and bad guys, heroes and villains but in the Entebbe/Jordan hijacking the bad guys thought that they were the heroes and the hostages were really thieves just in the end it became clear that the Rabbi was really an innocent hostage and those self proclaimed heroes were really hijacking someone else’s plane, and this story is no different, the Rabbi is a good guy who is being held hostage and the state is being hijacked but it really belongs to the people of New Jersey who have been funding this without ever being asked if they are giving consent!

    • So let me untangle the two stories that got Mixed toether here.

      Rav Hutner was finally let go from a hijacking in Jordan involving three planes in September 1970 . Many went to the airport to greet R Hutner when he arrived back in NYC on Erev Yom Kippur, including R Moshe Feinstein ZL. There was a music band there, and R Moshe ZL stopped the music because there were still other hostages being held and not all were free yet.

      The other story from Reb Krohn is the Air France hijacking from Athens, Greece to Uganda in June of 1979 where R Chaim Smulevitz said to the Mirrer Yeshiva : Daven like it’s your brother on the plane.

      • Allow me to untangle as well. The raid on Entebbe was July 4th 1976 (not 1979). America was busy celebrating the 200th anniversary of its founding.

  2. Amazing! With so much real corruption going on in NJ from top to bottom, they have needlessly spent millions upon millions of dollars ON ABSOLUTELY NOTHING!
    And that’s exactly the problem…..they have nothing to show for all the money and energy wasted so they have to come up with SOMETHING……ANYTHING to point of absurdity.

    • As far as I understand a Brady violation invalidates the verdict. It does not necessarily invalidate the prosecutor’s ability to retry the case.
      There is an argument to be made regarding spoliation of evidence, but that was not the argument that was brought.
      There are courts that have thrown out verdicts with prejudice for Brady violations, but that varies jurisdiction to jurisdiction.
