In a monumental win for Agudas Yisroel and religious freedom, a Brooklyn judge has issued a permanent injunction against all of NY Governor Cuomo’s restrictions on houses of worship.
The Agudah filed a lawsuit against Cuomo’s executive order restricting capacity at houses of worship in orange and red zones in October, alleging that the restrictions violate the Free Exercise Clause.
In November, the US Supreme Court issued a preliminary injunction against Cuomo’s restrictions, ruling that the 10- and 25-person restrictions at houses of worship weren’t “neutral” or “generally applicable” because many businesses were not subject to the same restrictions.
The lawsuit was then sent back to the lower courts, and today Judge Kiyo A. Matsumoto of the District Court for the Eastern District of New York issued a permanent injunction against Governor Cuomo’s restrictions.
