Jackson Township has yet another lawsuit to contend with, as an applicant seeking to build homes in the township filed sued them yet again, this time in state court.
As previously reported on TLS, the applicant for the Jackson Trails development filed a lawsuit in federal court alleging that discrimination against Orthodox Jews is the reason why Jackson Township declined his application.
The Township recently asked Judge Michael A. Shipp, the presiding judge in the case to dismiss several charges, including that made by the applicant that his development should have received the green light due to Fair Share Housing laws.
Judge Shipp agreed to dismiss the charge given that Fair Share Housing laws are outside of his court’s scope, but gave the applicant permission to refile the case in state court.
Today, the applicant did just that, filing a lawsuit in New Jersey State Superior Court, asking a judge for a Builder’s Remedy, which would levy a financial fine on Jackson Township and force them to allow many of the plaintiff’s application requests , if the judge ultimately agrees with the plaintiff.
