White House Response To Rubashkin Petition – Why We Can’t Comment

By: The White House. Thank you for signing the petition “Call an Investigation into Allegations of Prosecutorial & Judicial Misconduct in the Case of Sholom Rubashkin.” We appreciate your participation in the We the People platform on WhiteHouse.gov.

As explained in the We the People Terms of Participation, the White House may at times decline to comment on certain specific matters properly within the jurisdiction of federal departments or agencies, federal courts, or state and local governments in its response to a petition. For important policy reasons, this includes specific law enforcement and judicial ethics matters. With respect to law enforcement matters, the Department of Justice is charged with investigating crime and enforcing our laws. The Department also has mechanisms in place to investigate allegations of prosecutorial misconduct, including through its Office of Professional Responsibility. With respect to judicial ethics matters, the Judicial Conduct and Disability Act of 1980 vests primary responsibility for investigating and adjudicating claims of judicial misconduct with the Judicial Branch.

This petition calls for an investigation into allegations of prosecutorial and judicial misconduct in the case of Sholom Rubashkin and for action to correct the “gross injustice” in his case. For the reasons given above, the White House declines to comment on matters raised by this petition.

  1. Unfortunately they’re 100% right, I said it all along the White house cant give an opinion on something that’s in the hands of the courts.

    Hopefully the publicity will accomplish something and may he be released quickly!

  2. This entire online petition was only added by obama to harvest email addresses to be used for campaign email blasts as 2012 elections get closer. For those that did not relize yet what a faker he is…

  3. Well he can send whatever he wants to my spam email address I use for such stuff. It will be mixed in with all the “coupons” and special savings offers I receive every 3 minutes

  4. I wouldn’t vote for him no matter how many e mails I receive. I also throw away all political mail as soon as I take it out of my mail box. I don’t need flyers and e mail to tell me who to vote for.

  5. I hope there is no outcry of, “Anti-Semitism!”
    The Bush administration would have been equally unable to comment on the petition.
    What matters here is that we showed that the cause has widespread support.

  6. i said this from day one this petition along with most other petitions are a waste of time. people who were advocating this petition dont understand the mechinisms of government, politics etc.

    He has no shoulders to answer this clear abuse of the Judge.

  8. Wait a minute. Did not the White House respond thusly to the petition?

    Why therefore can’t the President direct the Justice Department to investigate the allegations of prosecutorial misconduct in the Rubashkin case, through its Office of Professional Responsibility? Isn’t the Justice Department part of the President’s cabinet?
    What am I missing here?
