A judge in Texas has temporarily blocked President Barack Obama’s orders to shield millions of people who are in the United States illegally, backing 26 states that argued Obama had overstepped his legal authority.
The White House said on Tuesday that the Department of Justice would appeal the action by U.S. District Judge Andrew Hanen in Brownsville, a city along the Texas border with Mexico.
Hanen has previously issued opinions critical of the Obama administration’s enforcement of immigration laws. An appeal of the judge’s temporary injunction would go to the majority conservative 5th U.S. Circuit Court of Appeals in New Orleans.
It was not immediately clear what impact Monday’s injunction would have on the fight in the Republican-led U.S. Congress over legislation passed by the House of Representatives to allow funding for the Department of Homeland Security only if Obama’s immigration actions were nullified. What a shame… It’s good sense to prioritize deportations according to criminal history and family status. Please explain to me why it’s a bad thing to give 1) children brought here by their parents the ability to stay so long as their are criminals here illegally who need deporting first and 2) families given the ability to stay as long as their are criminals here illegally that need deporting first. As I understand it, the President’s policy is a essentially a guideline for DHS to follow when selectingn which illegal immigrants should be deported. So why is this bad?
Because we have laws and the president is not an emperor he must obay and uphold the law
period.
We want to change he must go negotiate (something this narcissist in the White House can’t do) with Congress.
And guess what Congress was voted in by the majority of the American people, can say No, end of story.
Abe. You put it very well! America is a country with checks and balances…even if the pres comes up with a plan that will work he needs to convince others ….part of his job is to get along with the other 2 parts of the government. Although he enjoys saying how if congress wont agree to him hell go on it alone…thats not the way america was built. Lets hold out until the new pres gets sworn in…
Abe & why:
You are right America is built on laws and checks and balances. One of those checks and balances is for the executive to take action where congress fails to do so. As the executive, it is within the President’s purview to exercise prosecutorial discretion, much the same way local police enforce the law yet do so in a way that will yield the best results. If cops would enforce every crime, every time, we would all be broke. We know that they cannot, so they use their resources in a way that will maximize the benefit- by ignoring the jay walkers and policing the burglars. The Preseident also has the ability to direct his limited resources where he believes they are most useful. I do not know the numbers, but suppose there are 100 illegal immigrants. If we only have the capacity to deport 50, then shouldn’t the chief executive implement guidelines to make sure he deports the right 50? Not break up families or send back children who grew up here and have known no other home? This sounds like basic common sense and an ideal American and Jewish values should embrace.
