Toms River Township approved a settlement with Fair Share Housing that formally sets the township’s affordable housing obligations for the upcoming state-required round. The agreement establishes the number of units the township must accommodate going forward.
Under the settlement, Toms River will be required to allow 186 newly constructed affordable housing units. These units will be distributed across several locations identified in the plan. The remainder of the township’s obligation will be met by placing long-term deed restrictions on existing apartment units, which allows the township to comply with state requirements without authorizing large additional development.
The settlement resolves competing claims over the township’s affordable housing responsibility and avoids the possibility of higher unit obligations being imposed through litigation. With the agreement now in place, Toms River has an approved plan that outlines its affordable housing commitments for the next decade.
