Residents To Appeal Judge’s Decision On Cell Tower

cell tower presidentialThe Plaintiff in the Cell Tower case – Presidential Estates – plans on filing for an appeal on the Judge’s recent decision to dismiss the case, area residents confirmed to TLS today. The residents, who initially filed the case on November 23, 2010, say they were unaware of the cell company’s intentions until they noticed the tower going up. By then however, the Judge says, it was too late.

Earlier this week, the Judge dismissed the case saying it should have been filed within 45 days of the plan’s approvals. TLS.

  1. A majority of the comments on this website are people complaining about their taxes. The town does something that will bring in income and the cell tower is almost 3 times the required distance for residential neighborhoods. You have these residents here suing the town making everyone else to pay for the town to defend this (moderated). Thanks.

    Don’t you know that small fine print in the rear section of the paper is not enough when your neighbor wants to make zoning/adjustment/etc changes in your immediate neighborhood?? How would you like to wake up one morning and find a 5 story building right next door to you without being noticed prior to any proposed changes, and without being reasonably given an opportunity to state your opinion or objection on a matter affecting your own backyard.

    What YOU don’t understand, zydeco, is that YOU can’t have it both ways!!

  3. Now you know how the rest of the township residents feel when school’s and schuls pop up in residential neighborhoods without having a say about it. Get Over It and live with the tower like everyone else in this town.

    when a project is proposed, property owners within a 200ft radius are sent notices. and, as anon correctly stated “the cell tower is almost 3 times the required distance for residential neighborhoods…”

    so please people- dont complain about taxes then file frivolous suits the town needs to spend more money on to defend. its redundant.

    sounds like they are waisting their time!
    welcome to what many of the rest of the long time residents have been putting up with when thing pop up in our neigborhoods

    No proven health risk from cell towers , your phone to your ear all day long much bigger risk !!!

  7. What’s wrong here is that presidential is within 200 of the property. The township did not give them the required notice and since they don’t read the app they didn’t know of the meeting (which btw wasn’t posted till 2 weeks after the meeting took place). I am most concerned of the township doing things by the book that is morally wrong as in this case. If they can do it there than they can do it next in my backyard. The township took advantage of the people once again.

    well Iv’e been here a long time and this town has let many things happen in neighborhoods without the concern of those who live there .The fact that the people do not read the paper is not the fault of the township ,if it was posted there , legally they met what is required notification wise.
