Letter: As residents of a condominium community in Lakewood, we have been living peacefully with all our neighbors for the past four years – except for the few members who have been adamant not to change with the times and accept us as their new neighbors.
For multiple years now, prior to elections, the association would find reasons to manipulate the rights of the new voting members in order to prevent the incumbents from being removed from the committee. This has caused issues, as they refuse to allow the basic essentials needed that go along with a growing community i.e. safety precautions, religious rights…
This year, they have reached a new level of manipulation.
At the beginning of this year, the president and board members switched managements without notifying the members in the community. Since then, there have been multiple issues.
One of the major problems is, that multiple monthly payments have not been made to the correct management company as the system changed. Many landlords were not aware about the new system and were therefore delinquent in payment. No notifications were sent out to inform them.
Upon reviewing their account prior to elections, they were told they cannot vote or even discuss their status as their account has been sent to the lawyers already.
When reaching out to the community lawyer, he denied all knowledge of everything. For those who have paid up, the books are not showing their accounts correctly with underpayments, and others show over payments. Members have sent their bank statements in to prove payments, but to no avail. In addition, many bogus violations and fines have been sent out to the new members over yom tov.
We are seeking legal counsel to help assist our community in this time of need.

It’s a serious issue that HOA do not operate according to the legal law by not having selections, not notfying residents of quaterly meetings and changes, creating unlawful rules such as a 2 year ownership requirements before one can be elected to board, refusing to immediate step down from board once board member has sold residence and so much more…passing rules to make it difficult for others to move in because of their religion or race.
Besides for getting legal advise and help, you can also file a complaint with the state yourself. There is a form online which needs to be completed and summited along with all proof necessary showing criminal activity.
@Take Advantage. Just want to clarify one item you mentioned. Not every HOA has a requirement that you need to be an owner in order to sit on the board. In many HOA, the only requirement for a person to be able to be elected to the board in the Deed and by laws is that the person is over 18 and of sound mind.
HOA’s are tough to deal with, and are unfortunately easily corrupted. I’ve dealt with many and I could definitely relate. Under the HOA’s governing docs and the NJ Condominium Act, HOA’s are given a great deal of power which is often misused. Most often your only recourse is to go to court. However, if your pressed for time and your being threatened with legal action, you should know that under NJ law HOA’s are required to offer ADR (Alternative dispute resolution) before proceeding to court. This doesn’t always resolve the issue but it can help you stall for time.
