The Lakewood Board of Education today had some sharp words in response to the lawsuit filed by fired Supervisor Helen Tobia – first reported last night by TLS.

“Ms. Tobia’s lawsuit is a self-serving frivolous case brought by somebody who was recently found guilty of eighteen tenure charges of unbecoming conduct, including submitting a false affidavit to a Court in a special education case involving the Lakewood School District,” Attorney Marc Zitomer told TLS. “In fact, the tenure charges which she alleges in her lawsuit are “fabricated” were recently confirmed by a well-respected Superior Court Judge when Ms. Tobia sought to have the Arbitrator’s decision thrown out. Therefore, Ms. Tobia has no credibility whatsoever.”

Zitomer adds, “Ironically, many of the issues Ms. Tobia complains about in her lawsuit were matters she was found guilty of in the tenure dismissal case. Thus, it is clear that Ms. Tobia has decided to jump on the litigation band-wagon against the Lakewood School District, like many disgruntled employees before her, in order to feather her nest at the expense of the children and the Lakewood taxpayers.”

It is also a disgrace that she named the Lakewood State Monitor in her suit, says Zitomer, since he was brought into Lakewood by the DOE to help get the District back on track.

“This smacks of retaliation since it was the State Monitor who filed the tenure charges against her, all of which were proven and resulted in her termination.”
