Serious drug charges against two Lakewood men were dismissed Tuesday after a prosecution witness came forward with information that officers found a kilogram of cocaine in their truck before they had a warrant to search it. Assistant Ocean County Prosecutor Joseph Mackolin on Tuesday morning dismissed charges against Julio Magano Estrada, 20, of Elm Street after a pretrial hearing at which Sgt. Joseph Vitiello of the prosecutor’s office testified that officers working for the prosecutor’s narcotics strike force found the kilogram of cocaine, worth $100,000, in a truck occupied by Estrada and another man before they had a warrant to search it.
Both men would have faced 10 to 20 years in prison if they had been convicted. Read full article in APP.
It’s interesting how the exact letter of the law only applies to criminals, when it’s in their favor.
They are illegals and therefore above the law. I am surprised they even got arrested on drug charges and were not just let go. There are many many reasons why search could have been legal.
if they were in fact illegal aliens then the constitutional law of no searches without a warrant does not apply to them, only u.s citizens are protected by the constitution
