Due to a potential surge in monetary issues relating to COVID-19, Bais Din Maysharim and Bais HaVaad of Lakewood have cooperated with dayanim in America and Eretz Yisroel to assist those seeking guidance on these matters. Due to the complexity of the matters at hand, this work will not be completed before Pesach.
In the interim, they present the following limited guidelines, to assist Morahs and parents in how to proceed.
This document should not be considered a ruling for any party, but rather serves as general guidance which the parties are recommended to follow if they would like to settle the issue without having their case adjudicated in a formal din torah.

If a morah collects even some of the money, wouldn’t she then be ineligible for unemployment?
what about tuition payments for elementary and high schools and girls/ boys?
Every person should try to the best of their ability to pay the playgroup / babysitter morahs the full tuition. They put in unbelievable dedication to the children. As it is, it is becoming harder and harder to find morahs and babysitters as many women opt to get degrees. Many of the teachers will not be able to collect unemployment due to the nature of how they are paid. Again, if you are able, it will be a great zechus for our wonderful kehilla!
Why is this letter apply to playgroup only, the school’s should not be any different they are doing pure gniva by charging my credit card. I don’t have any income now. Even if they paying full checks for all their employees which I hope they do, how does it justify to charge full amounts their buildings are not being used, and who the heck needs their stupid lunches. Is there any reason why I have to max out my credit cards while I am struggling at home it’s mind blogging how everyone is staying quiet and pretend as if this isn’t a problem
Same applies to property taxes. The states should be tried in court by stealing money from all property owners
My wife is a torah and we can’t afford to not get her usual paycheck for march and moving forward . Would she be allowed to use the unused portion of her April paycheck and find other employment ? This 1/4 peshara doesn’t really keep the lights on(literally )

I’m not getting involved in the actual psak as we have to trust the dayanim to go through halacha and give a psak. I would like to point out however that we live in a Medina shel chessed and every legal private business is now eligible for compensation that would help these morahs. Because of the nature of how many of them run they will not be able to collect this money. The parents actually lose out on benefits entitled thru taxes and programs because of the way they run. Do we have to pay for their decision now too?

I think it also important to consider that many parents are home with their kids and cannot make ends meet. Maybe the Morahs can give their Massur money to the parents that need it.
Same with the schools.
My school charged my credit card for April without a blink of an eye. I think their should be guidelines for schools as well.
On a disagreementbof the poskim we generally say that if the money found its way into the other parties hand, that he becomes the muchzak especially if it came to him willingly. I do not know the status of a check in this regard but the ommission of this important detail particularly if money was already paid is puzzling.
Money wasn’t paid. They cannot cash it if they tried in advance. It’s a guarantee/collateral that their $ WILL be paid, but it is not payment. Moreover, the agreement is an “oral contract” by which the payers and the paid agree that the paid is providing a service for which he is getting paid for. If in middle of the school year the Morah (or school) would just close ,under normal circumstances, everyone would agree that they are not entitled to the compensation
Many Morahs reporting income are part of Toddler Academy. Morahs are not eligible for disability or maternity leave on this program as they are self employed. There is an EXCEPTION now. According to the new stimulus bill passed, self employed will be eligible for unemployment benefits. Besides for the two thirds weekly payment, there will be an additional 600 dollar weekly payment, no matter if your total income was less than that amount. Let’s say you report 400 a week. You will get from unemployment 250 and 600 = 850 a week. That is more than you are making (3400 monthly).There may be no need to collect payment from parents. Check into this with your accountants or …..
You are eligible for the $600 weekly extra unemployment benefit no matter your income level. Even if you earn $200 a week, you would be eligible for the $600 and $140 unemployment.
