How to File a Pothole Damage Claim in New Jersey

pothole 12-10-14 marys lane tlsYou must first determine if the pothole incident occurred on a local, county, State highway or on a toll road. For incidents on local or county roads, please call the respective township/county or visit their websites. If your accident was on the Garden State Parkway or the New Jersey Turnpike, please visit http://www.state.nj.us/turnpike/maintenance-issue.html or call 732-750-5300.

Accidents on the Atlantic City Expressway are handled by the South Jersey Transportation Authority. You may visit their website www.sjta.com or call 609-965-6060.

2. Upon determining that the pothole incident occurred on a State-owned highway, you may fill out the PROPERTY DAMAGE CLAIM-SHORT FORM.

3. The Registered Owner, and not the driver, of the damaged vehicle must complete, sign and date the Notice of Claim and mail it to the address on the form within 90 days from the date of the incident to preserve their legal rights. The preferred method is via certified mail return receipt requested. Please keep copies of the claim form and submittals for your records.

4. The claim form must, at a minimum, include:

(a) An estimate for repairs and/or a receipt showing proof of payment for any repairs made;

(b) Specific location where the incident occurred (nearest exit, mile post, cross street, relevant landmarks, etc.)

(c) A copy of an official police report, if one was filed at the time of the incident;

(d) A copy of the Declaration page of the auto policy for the registered owner of the vehicle. However, photos of the pothole are not necessary.

5. Please allow 3 to 6 months for your claim to be resolved. You should note that payment/reimbursement is not guaranteed.

  1. Don’t waste your time. The state of New Jersey has very broad immunity laws. Potholes during “pothole” season are very hard to litigate

  2. The State has a third-party adjusting company on their payroll to find every excuse in the book (and not in the book) to deny any payments to claimants. These “adjustors” are paid based on their performance to keep payments for claims to a minimum.

  3. The State has a third-party adjusting company on their payroll to find every excuse in the book (and not in the book) to deny any payments to claimants. These “adjustors” are paid based on their performance to keep payments for claims to a minimum. In fact, in 2013 the State paid only 12 claims for a total $3,656.60. And in 2012 they paid only 13 claims totaling $4,715.59. So if you do file a claim, do it right, but don’t get your hopes up..

  4. to every one out there and especially the township of lakewood could you explain to me why they placed cones by the pot holes on clifton and main and then removed them without filling the pot hole if it was a danger which it was it should have either been filled or the cones should not have been removed

  5. My wife was driving my car on March 31, 2017 from work to home. The two front wheels of the car were seriously damaged when crossing the pothole. I had to buy two new wheels in order to get my car ready for the next working day. The total price of the damage was 396.06. I will fill a claim but I don’t know if this procedure works.
