Father And Son Who Robbed Man In Raintree-To Be Sentenced

courtA father and son from Howell-charged with robbing a deliveryman from a VIP Chinese Restaurant- are to be sentenced for the robbery committed in April-in the Frum Raintree area-as first reported here on TLS. The father and son on Tuesday both admitted to their roles in the food heist. The son, Kevin Davis, 19, of Seattle Slew Drive admitted that he threatened the deliveryman, Bin Chen, to induce him to turn over $30 and the food they had ordered. The father, Timothy A. Davis, 48, of Smith Street, admitted that he drove his son to Ventura Drive in Lakewood, the location where they had requested the food to be delivered, knowing that his son planned to rob the delivery person.

“You were the wheelman?” Deputy Assistant Public Defender Michael Vito asked Timothy Davis at a plea hearing before Superior Court Judge Francis R. Hodgson. The elder Davis answered affirmatively.

Both the father and son pleaded guilty before Hodgson to second-degree robbery, amended from an initial charge of first-degree or armed robbery. Vito said that while the victim had reported that he thought the robber had a gun, no firearm was ever recovered.

Assistant Prosecutor Michael Weatherstone said he will recommend that both the father and son be sentenced to seven years in state prison and that each be required to serve 85 percent of their sentences before they can be considered for release on parole, under the terms of the state’s No Early Release Act for violent criminals.

Both are scheduled to be sentenced Nov. 6.

Police said the robbery occurred about 11:30 p.m. April 21, as the delivery person was leaving the address he was called to when the resident told him she had not ordered the food. After the robbery, the victim called police and gave them a description of the robber, the car he fled in and the cell phone number used to place the food order.

Police stopped the Davises’ car on Pine Street, dialed the cell phone number provided to them and heard a phone ringing inside the vehicle. They arrested the father and son and recovered the food before the defendants had a chance to eat it. TLS/APP

  1. Now that’s truly a sahme. They didn’t even get to eat the food. Is it really worth it for a losy $30 and some food they will sit for close to seven years. Good riddance.
