Failure to pay a minor traffic ticket, can get you arrested and locked up, something a local resident learnt the hard way. At about 2PM yesterday, a resident driving on Clifton Avenue when he was pulled over for allegedly failing to yield to a pedestrian crosswalk.
The driver was asked for his license and registration and when the officer ran his license, the system showed there was a warrant out for his arrest attached to the license, due to an outstanding summons.
The summons he received was issued in New York for having a burnt out lamp on his vehicle, but the ticket was never paid.
The officer returned to the driver and informed him he was under arrest.
The driver was cuffed, placed in the patrol vehicle and taken into police headquarters for processing.
Upon arrival to headquarters, two Askonim were already on hand to ensure that he was released in a timely manner.
The Askonim thanked Sergeant Steve Vigna, Officer David Sussman and the Court Clerk for their cooperation and assistance in the matter. TLS.
That is why you should ensure that even the smallest ticket or summons is taken care of in a timely manner. The next time a police officer pulls over someone for a minor moving violation, they may find that the person has a warrant out for their arrest, and that person may be you. Don’t let it escalate that far, and pay your fines! It really is THAT simple.
A small ticket when not paid can get you arrested and let me tell you with some of the officers on the road its a sakana if your at their mercy! I can’t explain any more but if you do get arrested I would ask to have a second officer respond and oversee
Glad that there are askonim with connection to the police department that are willing and able to help the tzibbur. Power to them!!
Is this normal people or military rule? Let the punishment fit the crime.
It’s time for the people to fight for their rights.
Someone shoots, arrest. Someone lightbulb burnt out Not.
I know the police officers who are vèry good read this blog. And they will all be kvetchen how u have to follow the laws, but some laws are just unfair.
Mark – You’re (moderated).
If you feel the laws are unfair, vote out the politicians who wrote those laws. But until that happens, THE LAW IS THE LAW.
What you are saying is that if someone doesn’t like a law, or feels that a specific law is unfair (like you do), they should be able to ignore the law, or break the law, or the cops shouldn’t enforce that law.
If you use your warped logic, If someone thought that the law against killing was too stupid, and he was just not going to llisten to that law, would you understand him if he decides to break the law, and kill someone? Would you understand the cops if they refuse to enforce the law against murder, if they feel that the law is unfair (for whatever reason they may have)? Of course not!
THE LAW IS THE LAW. If you don’t like the law, vote out the politicians. But until then, we all listen to the law, whether we like it or not.
(PS – I’ll bet you’re one of those people who never vote. Then you complain when the politicians write laws that you hate.)
Fair or not, its clearly stated on the ticket. “Failure to pay…..subject to … fine(s) or imprisonment or both…” My question: is the lamp still burnt out?
here we go again people think they can pick and choose which laws they will obey ,if you want to live in a lawless society please find some where else to live
I don’t think and Police Department in New Jersey would arrest someone in NJ for an outstanding TRAFFIC TICKET in NY. And TLS what exactly is
” failing to yield to a pedestrian crosswalk.” Last time I checked you don;t have to yield to a pedestrian crosswalk UNLESS there is a PEDESTRIAN in the crosswalk.
This does not make any sense. A cop has to use his common sense.
you get a ticket, pay it, if you think you can fight it, fight it. do it
this is wrong for so many reasons.
our police officers should be involved in fighting real crime, not worrying about tickets for new york city…is nyc footing the bill for lakewood PD time or are we?
this also can lead to an abuse of authority.this is an example of it. when someone doesn’t pay the police he’s cuffed? which other enterprise uses physical force to ensure timely payment. Soon they will cuff you for not paying your taxes on time. this is ridiculous.
why dont they write who the Askonim were?
A failure to pay a fine in New York gets you arrested in New Jersey???? That’s terrible!
It’s called contempt of court.
Nothing do they have been doing that since the 50s and 60s
Happy Birthday David Sussman February 8th!
An admirer who sares your birthday!
Quote “This does not make any sense. A cop has to use his common sense.”
Thats exactly what he did , again you cannot pick and choose which laws you want to abide by, some real foolish things being posted over what is just the correct procedure this LPD followed.
i agree with comment #11. The police don’t have to and should not cuff someone for not paying a ticket. Its common sense.
And of course someone gets in trouble for not obeying the law and its back to bashing the LPD.. Don’t do the crime if you can’t do the time.
Nobody seems to get it. Story makes no sense. NY would not enter a ticket in ATS and therefore Lakewood PD would not arrest for an outstanding warrant out of NY. (for traffic)
#17 you are wrong. When you are stopped for a traffic violation and they find a warrant for your arrest, they have no alternative but to arrest you. The warrant probably just notes “Contempt of Court”. Judgement does not come into play.
# 11, you know if you dont pay your taxes you could go to prison. The IRS is a lot harsher than the Lakewood Police, who try their best to help people out of tickets.
as usual we have the loudmouths bleating- THE LAW! well there are laws about public property and what goes on in tent city is NOT ENFORCING THE LAW! it seems the police are busy cuffing those who haven’t paid their tickets in other states, but what goes on in town is IGNORED. so quit preaching the LAW!- TENT CITY SHOULD BE CLOSED NOW before more fires and deaths occur. enforcing all the laws on all citizens is the only fair way to go. that includes giving parking tickets to those parked illegally by ALL types of houses of worship and not just shuls.
I’m stumped!!
Great post. I think that they can’t enforce the tent city because of the possible repercussions
This would not be acceptable in any other town to release someone in a timely manner. PAY UP or Get LOCKED UP. Just like if you don’t pay your electric bill it gets turned off. Laws are laws and there should be no exceptions… case closed and NO I am not a cop.
How does Tent City have anything to do with this article? Let me break it down for you- the man had a warrant, he was pulled over by the police and taken into custody. End of story. LPD can not just storm into Tent City like the military in a third world country and manhandle these people onto the streets. It’s the people who have never had to struggle and worry about making ends meet that want to shut the encampment down so badly. If you had any compassion for your fellow brothers and sisters you would see they don’t hurt anyone by living in the woods, it just offends you because you have nothing else to complain about. Where would you have them go? G-d bless the LPD and those who are so down on their luck that they have no resort but to live in the woods with the elements.
I’m glad someone brought up tent city. If like all the posters are statint that you can’t pick and chose laws. What gives the township the right to ignore the saftey issues in tent city (never mind that its a million percent illeagal)but if someone didn’t pay a silly traffic ticket, off he goes.
Something is very wrong here.
since when does nj arrest someone for a new york state warrant? especially for a minor infraction such as a burnt out bulb?
is this what we waste our police force for when we have people being held up at gun point 3 times this week alone?? the system seems to need an overhaul their should be a priorty list of when we enforce and arrest someone we are becoming more of a police state rather then a democratic society of LIVE AND LET LIVE
Do the people in rent city bother you? No. So be quiet and pay your fines. You arent above the law
The ignorance of the comments is breathtaking and mind-boggling.
I’m betting that most of these ignorant people have no idea how the country works, and how laws work.
So let me explain to you:
THE LAW IS THE LAW, whether we like it or not.
When Lakewood Police pulled over this person, they did a background check on him, like they do whenever they pull someone over. HE COULD BE A TERRORIST, for all we know. They did a background check on him, and lo and behold, they found a WARRANT FOR HIS ARREST from NY.
When a Police Officer pulls someone over, anywhere in the country, and the guy has a warrant for his arrest, from any state, issued by a judge, the cop arrests him. End of story.
BUT THE POLICE HAVE TO ARREST someone who has an arrest warrant out on him. THE GUY COULD BE A TERRORIST, for all we know. So we arrest him, no questions asked, and then we ask questions later.
As for Tent City: Yes they are illegal. However, Lakewood Township and Lakewood POlice are not allowed to do anything WITHOUT AN ARREST WARRANT from a judge. First they need to go to court to evict them, and then if they continue to stay there in contempt of court, THE JUDGE will issue an arrest warrant. A cop can only arrest someone if there is an arrest warrant issued from a judge or if they wittness a criminal offense in action or have reason to believe that a criminal offense was committed. VIOLATING A TOWN ORDINANCE IS NOT A CRIMINAL OFFENSE, AND YOU CANNOT GET ARRESTED FOR THAT, UNLESS A JUDGE GIVES AN ARREST WARRANT.
Lakewood Townshipp is in the process of suing the residents of Tent City in court. There is nothing more that Lakewood can do right now. The cops can’t just go in there and arrest them, without the arrest warrant from a judge.
But if you DO have an arrest warrant from a judge, no matter how small the infraction, you WILL get arrested, anywhere in America that you are caught. In fact, you will probably even get arrested in a different country if there an arrest warrant on you from NY for not paying a traffic ticket.
If you don’t like the laws in NY, either vote in new politicians who will change the law in NY, or don’t go to NY in the first place.
In Singapore, if you are caught stealing $5, you will be caned (like the 39 malkus). Don’t like it? Don’t go to Singapore!
The ignorance of some commentators here is frankly appalling.
Cops are obligated to make an arrest regardless of where the warrant is from of what it is for. Only in Lakewood to people want to cry about it. If you followed the law and paid your ticket(s) in the first place this would not be an issue.
Its about Time….no one is above the law..people need to put the phones down already while driving
in new york if you have an arrest warrant from new jersey they wouldnt arrest you talking from experience
pd go get the gangs and leave the poor folks alone !
#32 of course
its all money thats all
