Driver Who Struck N.J. State Trooper Marc Castellano Won’t Be Charged Criminally

Twenty-year-old Robert Swan of Jackson struck and killed Trooper Marc Castellano on June 6 on Route 195 in Howell. He was cited for speeding and careless driving. Swan was driving a 2010 Volkswagen Jetta at 75 m.p.h. in a 65 m.p.h. zone when he struck Castellano in the shoulder of the roadway, authorities said. AP.

Why no ticket for driving on the shoulder? Is that legal?(That could save some serious time in a jam!)

thats where the careless comes into effect, that or failure to maintain lane…..both 2 pt tickets
