Correction: Motorola bikes belong in the street.
It’s an issue here for there are no bike lanes and sometimes no shoulders. But just the same if one is walking and crossing the street there need to look before crossing.

Clearly, the biker. Motorized vehicle (and bikes ridden by older teens & adults) legally should not be ridden on the sidewalk. Additionally, bikers who are riding on the sidewalk (should really only be children, in most cases) should be stopping at the corner to cross-preferably by getting off their bike/scooter to WALK across the street. If the biker had been allowed to ride on the sidewalk and had stopped at the corner or if he had been riding in the street, he would have had the right-of-way at the intersection and the car should have stopped for him but given the facts, the driver did nothing wrong.

This is a very common problem in the city usually like in Brooklyn or Manhattan those people come with bikes and especially the electric bikes and the mopeds, which are very dangerous for drivers, but the driver is in the city are used to it. I guess The Lakewood this is not such a common thing drivers aren’t used to look out for this.

Legally the car is at fault he has to look for people crossing. Even if the biker shouldn’t have been on the sidewalk

If a pedestrian hasn’t yet stepped into the decline towards the crosswalk, the vehicle proceeds first. The biker wasn’t yet there as the car started its turn.

TLS Commenter Answers Question Correctly, Advances To Second Round of Contest
TLS Commenter, Gershon Winman, advanced to the second round of a TLS quiz contest on Monday after he gave the correct response to a traffic-related question.
“I can’t believe I made it all the way to the second round of this contest,” a stunned Mr. Winman told reporters on Monday. “Who knows, if I keep trying, maybe I’ll win the whole thing! I know it sounds crazy, but crazier things have happened!”
However, Mr. Winman had a confession to make.
“I’m not gonna lie to you just 3 weeks after Yom Kippur,” he said, “I admit, I had some help answering the question, specifically, a local traffic judge who explained to me who was at fault for the bike rider’s fall.”
“However,” Mr. Winman asserted, “TLS rules do not prohibit commenters from seeking outside assistance with quiz questions.”
“I mean, can I help it if I’ve got a traffic judge living right next door to me who gives me the correct answer instantly?!” Mr. Winman said.
“It’s amazing,” the elated commenter confided, “I am now a second round contestant hoping to make TLS history!”
“Who would have thought that an ordinary commenter like me, who was raised in a typical Lakewood home, would advance to the second round of this contest!” he said. “It just goes to show you that ANYONE can make it to the top of the mountain, as long as he’s got a strong desire and a traffic judge for a next-door neighbor.”

The biker was at fault. The car was turning before the biker entered or was actually at the roadway. The biker should have looked before entering the roadway

from the video and the MPH. The car was going faster as he approached the turn, he didn’t slow down to make the turn, he didn’t turn on his blinker. Looks like it was a last minute decision to turn

It’s the bikers fault. Just because they ride a bike doesn’t give them always the right of way.
This almost happened to me while driving . A bicyclists went speading across the street without looking . It’s really scary out there . Bh I stopped on time!
A diff time a motor bike hit me and the boy was ok but he said I thought I could make it.

While in this situation I would say the cyclist was at fault for riding on the sidewalk. The driver however, should have also been aware of his surrounding since he passed him prior to coming to the intersection and should have seen him in his mirror as he was approaching the intersection.

If the cyclist was in the street like they should have been then it would have been the drivers fault for failing to yield as the cyclist would have had the right of way.
