He should be turning to the Constitution, not the psycobabble like Kennedy using Calhoun’s substantive due process creating new laws out of thin air, and certainly not to what he thinks the law should be, but what the law is. There is no such thing as a conservative or liberal justice. There is only those who make up law and those that do not.
