New Jersey Attorney General Matt Platkin filed an emergency motion today requesting an immediate stay of last week’s court ruling blocking most of the concealed carry gun law from taking effect, while pending appeal.
Writing in the motion, which was submitted to the Third Circuit of the U.S. Court of Appeals Monday morning, Platkin made the case that a stay is “urgently needed,” noting that last week’s preliminary injunction “prevents the State from enforcing its democratically-enacted laws.”
“This appeal warrants expedited consideration because the preliminary injunction interferes with a critical public-safety tool adopted by the New Jersey Legislature,” the motion goes on to say.
“The injunction threatens public safety by allowing loaded guns in crowded theaters, bars, protests, and Fourth of July celebrations in parks, as well as zoos and libraries where children gather — just to name a few.”
In her 235-page decision issued last week, U.S. District Court Judge Marie Bumb was highly critical of the law, passed by the Legislature and signed by Governor Phil Murphy in less than three months, calling it “plainly unconstitutional.”
The state appealed the ruling hours later, on the grounds that the “district court erred in preliminarily enjoining vast swaths of New Jersey’s sensitive-places and private-property provisions.”
Of course NJ appealed. The Dems will continue to fight tooth-and-nail to scuttle the 2nd Amendment and the right of law-abiding citizens to self-defense, as affirmed by the U.S. Supreme Court in the recent NY Bruen case. Hopefully, when the dust settles, leftist, constitution-violating governors Murphy and Hochul (and their rubber stamp Dem majority legislatures) will, once again, be slapped down by SCOTUS.
