BREAKING: Judge can decide on Lakewood BOE write-in winner after ballot confusion

ballotFIRST REPORT: The ballot confusion – first reported by TLS last week – could end up in front of a Judge, TLS has learned.

As earlier reported, the ballot listed a two-year open seat for the Board of Education, however, that seat was recently filled by Ms. Thea Jackson.

The BOE then released the following statement:

“Please be advised that the 2 year open board seat which appears on the ballot is not, in fact, an open seat. The seat was filled by Ms. Thea Jackson after the balloting information was sent to the County Board of Elections. The seat will not be up until next year for the balance of the term.”

After noticing they’d made a mistake, the Board of Education – which had certified the original submission – notified the County Clerk’s Office, but it was too late.

Ocean County Clerk Scott Colabella tells TLS, by the time they were notified, the ballots had already been printed, and the voting machines had already been programmed.

Today, the election results were certified, and Moshe Kuperwasser – who had been endorsed as a write-in by the Vaad – received several thousand votes, though they weren’t officially counted as legitimate – according to the Board of Education.

At this point, as far as the Clerk’s office is concerned, Kuperwasser had won the election – replacing Ms. Thea Jackson – if the ballot isn’t contested.

However, once the Board of Education receives the certified results, and stands by its correction of the ballot, they will need to go in front of a Superior Court Judge to rescind the ballot, Colabella says.
