BREAKING: Federal Judge Blocks Another Key Provision Of New Jersey Gun Control Bill

Just one day after a judge issued a temporary restraining order against several provisions of the recently enacted concealed carry restriction bill, a federal judge on Tuesday blocked another gun control related law.

Judge Zahid Nisar Quraishi, a Biden appointee to United States District Court for the District of New Jersey, issued a preliminary injunction against a law signed by Governor Murphy in July which allows the New Jersey Attorney General to sue the gun industry for “public nuisance” violations.

The law allows the Attorney General’s office to sue gun manufacturers, dealers, and sellers for recklessly contributing to a “public nuisance.”

In his 20-page opinion, Quraishi noted that the New Jersey law seems to be in conflict with the Protection of Lawful Commerce in Arms Act of 2005.

The Protection of Lawful Commerce in Arms Act is a federal law that protects the gun industry from lawsuits when their products are used for a crime.

“It’s no surprise that the unconstitutional laws passed by Trenton Democrats to attack the rights of law-abiding firearm owners and businesses are falling like dominos in federal court,” state Senator Michael Testa (R-Cumberland) said in a statement.

“While Governor Murphy says the Bill of Rights is above his paygrade, thankfully we still have federal judges who understand what it means,” the Republican added.

The lawsuit was filed in Federal Court last November by the Connecticut-based National Shooting Sports Foundation, which described the law as “breathtaking in scope” and said it violates the First and Second amendments and the Due Process and Commerce clauses of the U.S. Constitution.

  1. Thank goodness Murphy’s anti-Constitution, authoritarian rule is going down in flames, little by little. It’s a darn shame that his re-election bid didn’t flame out as well! For that self-inflicted wound we have to thank the too many misguided folks who foolishly voted for him.
