Bill Banning Ghost Guns, 3-D Plastic Firearms Clears Assembly; If Enacted, New Jersey Would Have the Strongest Law in the Nation

No Ghost Guns. No 3-D Firearms. And no purchasing any component used in making either of these weapons. Legislation banning the manufacturing of any untraceable or covert firearm was approved 68-5-3 by the full Assembly Monday.

The bill (A-3129)- sponsored by Assembly Democrats Paul Moriarty, Gary Schaer and Annette Quijano – would make it illegal to purchase firearm parts for the purpose of unlawfully manufacturing firearms without a serial number and to manufacture or possess covert or undetectable firearms and 3-D printed firearms.

“Instead of making it harder for criminals to obtain weapons, new technology and mail-order kits are only making it easier for criminals to manufacture firearms at home,” said Moriarty (D- Camden and Gloucester). “Our only recourse is to arm our court system with additional penalties for those who choose to skirt the law, avoid licensure and manufacture these types of firearms to keep or even to sell. We’re saying no to ghost guns, and no to 3-D firearms. Not in New Jersey.”

The bill makes it a 3rd degree crime to: (1) manufacture, cause to be manufactured, transport, ship, sell, or dispose of any covert or undetectable firearm; (2) possess any covert or undetectable firearm; or (3) possess a firearm enclosed in a container or covering that is designed or modified to allow the firearm to be fired while so enclosed and that disguises or obscures the shape of the firearm such that it does not resemble a handgun, rifle, shotgun or machine gun.

“An untraceable and undetectable weapon is a nightmare for our police community,” said Schaer (D-Bergen and Passaic). “We may not be able to end this trend of covert weapons as quickly as we’d like, but we must increase penalties and ensure our law enforcement have the ability to prosecute criminals who evade existing gun laws.”

A covert firearm is a gun that resembles, but not limited to, a key-chain, pen, cigarette package, cellphone, smart phone, wallet, or cane.  An undetectable firearm is constructed entirely of non-metal substances, or one that does not include one major component.

“New technology and the make-it-at-home kits are making it way too easy for guns to get into the wrong hands,” said Quijano (D-Union). “This bill sends the appropriate message: New Jersey will not stand for it. If a person manufactures or possesses a ghost gun, or 3-D printed weapon or even buys the parts to make them, there will be additional penalties if convicted.”

A violation of this bill’s provisions is not to merge with any other criminal conviction. The court is to impose separate sentences for each criminal offense.

A crime of the third degree is punishable by a term of incarceration of three years to five years, a fine up to $15,000.

  1. A principal of one of the mosdos said in a shiur that the gedolim say that even fake guns are bad for chinuch, as it is a tool of murder. Someone asked what is so bad. He mentioned that there is a story where a child came with fake gun, and pointed it at someone – who though it was real, and shot the child. It’s really not good.

  2. More junk legislation. No law will stop a criminal from obtaining a weapon. If criminals followed laws, they wouldnt be criminals. 3d printed guns and the likes are difficult and expensive to create and highly unreliable. This is simply the governor pandering to the anti-gun activists. Want to see a change? Make it easier for law abiding citizens to defend themselves.

  3. Covert guns and undetectable guns are already illegal in Federal law. More redundant laws from NJ. Only thing new here is banning home manufacture which is federally protected. Hopefully this goes to Supreme Court.

Guns do not kill people,cops or kids.It’s the criminal pulling the trigger.For a country of supposedly intelligent people,it seems to me we’re surrounded with stupidity.Take away our guns, then the only ones the cops need fear are the criminals.There the only ones with a gun. And by the way, if you do have the intestinal fortitude to defend your family or yourself, how do you plain to do it,with a bat? But then some “intelligent politician” will want to ban bats! Seriously, look back in history,you loose your freedom when you loose your ability to protect and defend yourself. Think I’m wrong,ask someone who lives in a place like that Start with any survivors of the Nazi’s concentration camps.Your loved ones murdered in front of you and you can do nothing, if you allowed a handful of hoodlums that could have stopped at the beginning,but they were allowed to take freedom and self defense away. No thanks, I’ll keep my freedom,whatever the cost.

  5. Sorry, my fellow conservatives. This is one issue where I do not agree with the conservatives at all. The more guns around, the more chances for horrible things to happen. I, for one, do not feel comfortable with any Yankel, Shmerel and Berel walking around with guns or having a gun in their homes. Even though they are not criminals, how do I know these people are emotionally capable of not over reacting? The fewer guns around, the better. However a couple of designated, vetted, very well trained people in each shul, who are armed, might be a good idea.

  6. History explains itself. Mass murder by governments happen when you take away guns from the population. Without a chance to defend your self. Stop messing with my 2nd amendment. Don’t like it leave the country. You figure we would know this by now.
