Attorneys In Perth Amboy Shul Trial To Appeal Judge’s Ruling

Following a Judge’s ruling in the case of the Perth Amboy Shul, Attorneys for the Shul will be filing an appeal, Attorney Larry Loigman tells TLS. Judge Ciuffani released the decision in the Perth Amboy Shul casetoday, and ruled against the plaintiffs, giving the defendants the rights to sell off the historic Shul.

“He said, plaintiffs waited too long to file the suit”, Attorney Larry Loigman who leads the legal team, said. “The version of the by-laws marked “proposed” required a majority vote, not a 3/4 majority as in previous versions; and religious considerations should not play a role in making this decision.”

The Attorneys however, are in the process of filing an appeal to the Appellate Division, and are very hopeful for a better outcome.

“I think that we will have a better opportunity to present the case in the Appellate Division, and, I am looking forward to a more favorable result”, Loigman said. “The trial judge clearly did not give our arguments the attention that they deserved.”

Attorney Ira Heller says, “The ruling by this Judge in the NJ Superior Court did not surprise us, as we have we have felt from the outset that he has not been particularly sympathetic to us.” Heller adds, “However, the trial did give us the opportunity to create an extensive record, which is full of compelling evidence that we will hope to present on Appeal. This issue is certainly not over. We strongly believe that righteousness is on our side, and we are determined to fight this to the end.”
