EXCLUSIVE: [Click here for Letter] The attached letter was submitted to TLS by the office of U.S. Republican Congressman Incumbant Chris Smith. In the letter – addressed to U.S. Attorney General Eric H. Holder in regards to the U.S. Vs Rubashkin case – the 15 term Congressman requests that Rubashkin be fairly tried and not be discriminated against because of his religious beliefs.

“While I am not writing to request relief for MR. Rubashkin, since his case is still pending, I urge you to take decisive action, consistent with your authority as Attorney General, to ensure that US Attorneys do not treat Jewish Americans, solely or substantially because of their Jewish identity, as a ‘Flight Risk’ so as to deny them their right to bail or any other right. As you know, the 8th Amendment to the Constitution has long been understood to imply that criminal defendants have a right to bail, at least in the absence in extraordinary circumstances-and the very notion that one’s religion could be such an extraordinary circumstance is profoundly repugnant to our Country’s traditions and to fundamental justice I also urge you to take all proper actions, consistent with US law and regulations, to ensure that US Attorneys handle all matters presented to courts, including sentencing and ex parte contacts, in a fair, even-handed, open, and uniform manner, completely free of religious bias. The fairness of our federal justice system depends not only on the decisions of judges but also on the actions of U.S. prosecuting attorneys”.
Christopher H. Smith, representing the 4th District of N.J., is facing Lakewood’s Howard Kleinhendler in this coming week’s elections. Smith has represented the 4th District of NJ in the U.S. Congress, since 1980.

Congressman Smith’s letter to The Attorney General seems somewhat tepid. He merely expresses his dissatisfaction with the Court’s initial reluctance to release Mr. Rubashkin on bond, based solely on the fact that he is a Jew.
Nowhere does he express outrage at the infamous miscarriage of justice perpetrated upon Mr. Rubuashkin. I believe that not since the trial of Sacco and Venzetti, has our judicial system displayed such blatant bias against a person of minority descent.
Perhaps we should hear how Mr. Kleinhendler weighs in on this issue and how far he would go in pursuit of justice.

the reason is because Congressman Smith is known to be a big advocate for equal rights, so this letter can be seen by the attorney general as being in line with other equal rights issues that he stands in the forefront of.
