Judge Expected To Consider Request For Injunction To Halt Work On Controversial Cell Tower

cell tower presidentialLarry Loigman Esq., the attorney in the Presidential Estates Vs Wireless Edge and the Lakewood Township case, has notified TLS that the Judge will be considering the request for a preliminary injunction to halt work on the cell tower. This past Tuesday, TLS reported about the lawsuit filed against the Township and against the company which placed the controversial cell tower on the Township’s property.

Residents of Presidential Estates, Chestnut, Somerset Meadows, Elmwood Village and Chateau Park became enraged over a cell tower placed by the company Wireless Edge about three months ago, which they say can possibly affect their heath, and will bring down their property values, as first reported here on TLS.

The Judge is expected to consider the request this coming Monday.

    there was nothing rellated to a health issue in the filling to halt work on this cell tower the PDF file was posted for anyone to read obviously whom ever wrote the above article did not take the time to read it

    the reason why the law suit did not mention health is that although the statistics for cancer, miscariages etc. is higher near cell towers, but because scientists couldn’t figure out why (i.e. they could not demonstrate a direct link), it has historically been thrown out in court. However, this case is very different than the cases that were thrown out in court. One reason (as mentioned in the suit) is that the township did not offer this lease to anyone else (by law, they need to offer township owned land that they want to lease to at least 3 bidders). Based on that alone, the contract be nol and void. Another difference between this and previous lawsuits is that here the township solicited this contract which is unprecedent for a township to welcome a cell tower near a residential neighborhood. The previous lawsuits were usually a question where either the cell tower company themselves owned the land or a private entity. In those cases it is more difficult to restrain them from constructing and operating the tower. There are some more differences, but I hope the township will settle this, so not everything will have be publicized.

  3. The reason the lawsuit doesn`t mention health issues is because the law in congress says that the public benefit of cell phones outways ANY health risks.Legally you can only fight because of property values.

    There is a concept of shmiras halashon. The writer of comment # 3 did not write who or what is not being publicized. If what needs to be accomplished, can be accomplished without anything negative being publicized on any specific person or entity, than according to the Cofetz Chaim that is the required route to take. In this case, I believe that the tower will be removed because the contract is nol and void for the lack of fulfillment of the 3 bids. I am not blaming any specific township committe men for intentionally not offering the 3 bids, but regardless of how that happened, this is the reality.

  6. If health is not an issue, what’s the lawsuit about?
    Who cares if the Township offered it to only one bidder? Why is any time/money or other resources being spent on this issue.
    Somebody with real information, please answer.

  7. Read comment # 3. Health is an issue! It’s just that being that the scientists could not figure out why (although statistics show higher rates of cancer and miscariages), the courts could not recognize that as a valid argument. That explaines why the health argument was ommited from the lawsuit. I know that I would not want to subject any of my family members to a greater risk of cancer etc., so please understand them.

  8. #8 – Although the lawsuit was filed in the “Law Division”, suits demanding an injunction would normally be heard in the “Chancery Division”. I suspect the application for a temporary injunction will be heard by the chancery judge. His court is not in the main court house, but rather on Courthouse Lane.

    well what do you think that means there is no link ! if you want to complain find something that has facts to support your position !there is a much greater risk of health with power lines magnetic field ,can you imagine asking to have these structures removed .
    Stop whinning and move on to a real issue.

  10. ok it seem as though voicing your oppinion here is not acceptable unless you are on one side of this issue. If you think there is a health issue it has to be supported by facts and there are none so that would never hold water in court (already has been tested in previous cases!)
    to all those who find this a major problem I say move on to something more important perhaps we can get power line towers removed becuse thet have been proven to be a real health issue with magnetic field they generate to those living in close proximatety

    Please don’t bring your religion into this issue!! nothing should be hidden from view good or bad . In order for open and honest government to function it needs to be transparent ,something here in lakewood that seems to be a problem !!

    you may be right, however that is not the issue at hand a decission was already made and the tower is now already erected Question who is going to be resposible for the expense if it does get moved? The Township ~ more money wasted!! I know I know more negative thoughts but truthful !!!

  13. its been proven time and time again that smoking and eating hot dogs causes cancer, yet no one seems too concerned about it except to complain a biut a cell antenna which has never been proven by anyone. go figure.

    smoking & cancer is a proven factual cause and effect yet those who choose to engage in this habit turn a blind eye to the health problems that inflicted by it. We can draw an obvious conclussion that unfortuanetly the concerns of ones health caused by this is not the determining factor as to whether cigarettes should be banned
    it comes down to $$$$$ money made by the Tobacco industry and the tax collected by it sales. We also now have a huge push by many states to legalize pot ,again driven by $$$
    lets not kid ourselves as to what really motivates what is accepted in society and what is not . There are some things we encounter in life that may or may not be harmful and the decission as to whether the bennifit outways the risk has to come into play . As far as our health goes even some medications are risky and in the long term can be harmful to some but at times may be life saving so there is no one single solution that fits all situations . My point being as related to the cell phone tower as a health issue ,first and foremost at this point there is no direct proven link to health probllems ,just as with making conclussions that are factual there needs to be more extensive research in this area before we can make accusations about the risks that it may or may not present. There are many other things we accept on a daily basis throughout our lives which are proven risky eg. just driving causes so many deaths each year but we know that you cannot ban cars or driving to prevent these deaths again risk versus benifit freedom of movement in a timely fashion (does anyone think we should go back to horse & carriage?) The things we can control on a daily basis such as choosing to eat properly, not smoking , excesise are personal choice for each indivudual to make .
    I like to make the analagy of a mother who is worried about her child going outside with the proper clothing and worries about the child getting a “cold’ yet finds no issue with not using a car seat for that child when driving .
    bottom line I think the issue here with the cell tower is more of one of a visual annoyance to those who live near by ,not that this may not be a valid concern ,but don’t make accusations that cannot be supported with proven data ,in the end the facts are what will determine what is a real concern and what is ficticious

    If it would have been an adult community bringing the lawsuit I am positive you would be on there side, OR you wouldn’t say anything.

  16. the tower behind Shop-rite, Coventry, Raintree, 4th & Lexington, River & Central. Didn’t it go before the planning or zoning board to get approval with public hearings?

  17. Those are all private property. It’s much different when you are dealing with Public Property. Public property is owned by all the residents of the town and is entrusted to the government to manage it correctly.
